WITHDRAWAL FROM THE CONTRACT IN THE INOBA.PL ONLINE STORE

Information on the right of withdrawal from a distance contract

As a consumer, you have the right to withdraw from a contract concluded in the Online Store within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you took possession of the goods or on which a third party other than the carrier and indicated by you took possession of the goods.

To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (for example a letter sent by post or by e-mail).

You may send the statement, for example:

- in electronic form by e-mail to the address: info@inoba.pl

A sample withdrawal form is contained in Annex No. 2 to the Ustawa o Prawach Konsumenta (Polish Consumer Rights Act) and also forms an annex to the terms and conditions of the inoba.pl store (/policies/terms-of-service#11). You may use the sample withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

In the event of withdrawal from this contract, we will reimburse you for all payments received from you, including the costs of delivery of the goods (with the exception of additional costs resulting from your choice of a delivery method other than the least expensive standard delivery method offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed of your decision to exercise the right of withdrawal from this contract. We will carry out the reimbursement using the same means of payment as you used for the original transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of this reimbursement. We may withhold the reimbursement until we have received the goods or until you have supplied evidence of having sent them back, whichever is the earlier.

If you have received the goods you purchased, please send them back or hand them over to us at the address: INOBA SP. Z O.O., Nowosiedlice 107, 56-410 Dobroszyce, without undue delay and in any event not later than 14 days from the day on which you informed us of your withdrawal from the contract. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are liable only for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

The provisions on the consumer contained in this notice apply from 1 January 2021 and, for contracts concluded from that date, also to a buyer who is a natural person concluding a contract directly related to their business activity, where it follows from the content of that contract that it does not have a professional character for that person, resulting in particular from the subject of the business activity they pursue, as made available on the basis of the provisions on the Centralna Ewidencja i Informacja o Działalności Gospodarczej (Central Registration and Information on Business).

60-day returns for newsletter subscribers

Irrespective of the statutory right described above, we grant a contractual right to return goods within an extended period of 60 days. This entitlement applies if, at the time of placing the order, you were subscribed to the inoba.pl newsletter, the subscription concerns the same e-mail address that you provided in the order, and your consent to the newsletter remains active on the day you notify us of the return. Unsubscribing from the newsletter before you notify us of the return means a return to the statutory period of 14 days.

The 60-day period is counted from the day on which you, or a third party indicated by you other than the carrier, took possession of the goods. In the case of an order comprising several items delivered separately, the period is counted from the taking of possession of the last of them. To meet the deadline, it is sufficient to send the statement to info@inoba.pl before it expires, and the goods must be sent back within 14 days of making the statement.

Under the contractual entitlement, we refund the price paid for the goods, and you bear the direct cost of sending them back. The price is refunded within 14 days of receipt of the goods, using the same payment method as was used for the purchase. The goods must be complete and must not show signs of use beyond what is necessary to establish their nature, characteristics and functioning. The contractual entitlement does not cover goods made to individual order or the other cases excluded from the right of withdrawal in accordance with Art. 38 of the Consumer Rights Act and point 8.9 of the Terms and Conditions.
